1. About these terms

These terms govern your use of The Candid Captures Company website and services (“the Service”), operated by Jack Wallace trading as The Candid Captures Company (“we”, “us”, “our”). By purchasing a plan or using the Service, you agree to these terms in full.

2. What you are purchasing

When you purchase a plan, you are buying a one-time licence to create and manage one event gallery using the features included in that plan. This is a digital service, not a physical product.

By completing your purchase, you agree to the immediate provision of the Service and acknowledge that you lose your right to cancel under the Consumer Contracts Regulations 2013 once the Service has been made available to you.

3. What each plan includes

Features are provided on a best-efforts basis. We do not guarantee specific output quality from AI features (such as highlight selection), as results depend on the number and nature of guest uploads.

4. Upload window

The guest upload window opens 14 days before your event date and closes 28 days after your event date. Outside this window, the upload page will be visible but guests will not be able to add new files. The gallery and admin panel remain accessible throughout the 2-year retention period regardless of whether the upload window is open.

If your event date changes, the upload window moves with it automatically.

5. Data storage and deletion

All event data — including uploaded photos, videos, and event settings — is stored for 2 years from your event date. After this period, the data is permanently and automatically deleted. We do not recover deleted data after this point.

Photos and videos are stored in Cloudflare R2 (europe-west-1, Ireland). Account and event data is stored in Supabase (EU West region). For more detail, see our Privacy Policy.

6. Payments and refunds

Payments are processed securely by Stripe. We do not store your payment card details.

All sales are final. We do not offer refunds. Because the Service is a digital product made available immediately upon purchase, you lose your statutory 14-day cancellation right at the point the Service becomes available to you. By completing your purchase you confirm you understand and agree to this.

If you experience a technical issue that prevents the Service from functioning as described, please contact us at hello@thecandidcapturescompany.com and we will investigate and work to resolve it.

7. Acceptable use

You must not use the Service to upload, share, or distribute content that:

• Is illegal under UK law or the laws of any applicable jurisdiction
• Infringes the copyright, privacy, or other intellectual property rights of any third party
• Is sexually explicit, violent, hateful, or harassing
• Contains malware, viruses, or any other harmful code
• Depicts or facilitates any form of abuse, exploitation, or illegal activity

We reserve the right to remove content that violates these terms and to suspend or terminate accounts without notice where serious violations occur.

8. Content ownership

You and your guests retain full ownership and copyright of any photos and videos uploaded through the Service. By using the Service, you grant us a limited, non-exclusive licence to store, display, and deliver that content solely for the purpose of providing the Service to you.

We do not sell, licence, or use your content for any purpose other than operating the Service.

9. Service availability

We aim to provide a reliable, continuously available service but do not guarantee 100% uptime. Scheduled maintenance, infrastructure outages, or events beyond our control may occasionally affect availability. We are not liable for losses arising from temporary unavailability.

10. Limitation of liability

To the maximum extent permitted by law, our total liability to you in connection with the Service shall not exceed the amount you paid for the plan in question.

We are not liable for any indirect, consequential, or special losses, including but not limited to loss of data caused by you not downloading your content before the 2-year retention period expires. It is your responsibility to download and back up your event photos before deletion.

Nothing in these terms limits liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation, as required by UK law.

11. Changes to the Service or pricing

We may update or change features of the Service over time. We will not remove features you have already purchased without reasonable notice. Pricing shown at the time of purchase is what you pay — we will not apply retrospective charges.

12. Governing law

These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
